North Dakota’s judicial system consists of a state Supreme Court, the Court of Appeals, and numerous district and municipal courts. The system is entrusted with providing “an equal and fair system of justice to citizens of North Dakota.”

North Dakota Supreme Court

The North Dakota Supreme Court is the highest court in the state. It is composed of five justices elected to 10-year terms by a nonpartisan ballot. One member of the court is selected by his peers to serve five years as chief justice; presently that man is Gerald W. VandeWalle. The chief justice’s duties include presiding over Supreme Court conferences, representing the judiciary at state functions and serving as the administrative head of the state’s judicial system.

The Supreme Court is primarily an appellate court with the responsibility of hearing appeals arising from the district courts and the North Dakota Court of Appeals. As an administrative body, the court is responsible for maintaining judicial conduct in North Dakota, supervising the state’s lawyers and adopting procedural rules that allow for the orderly and efficient handling of court business statewide.

The court’s Web site includes a searchable archive of its opinions, a docket search and calendar search, a page of court rules in the state, a directory of justices and staff, a schedule of court meetings and events, and a link to listen to Webcasts from the Supreme Court.

North Dakota Court of Appeals

The North Dakota Court of Appeals only hears cases assigned to it by the state Supreme Court, and is structurally and functionally one of the most limited appellate courts in the United States.

The court is composed of judges chosen from among active and retired district court judges, retired Supreme Court justices and even attorneys in the state. Temporary Court of Appeals judges are assigned by the Supreme Court to serve for up to one year.

In some years, the Supreme Court has not assigned a single case to be heard by a three-judge panel convening as the Court of Appeals.

North Dakota District Courts

North Dakota’s district courts are the courts of general jurisdiction for the state. They have original jurisdiction in all cases, including criminal felony and misdemeanor offenses, and civil matters as well.

District Court venues also serve as the juvenile courts in North Dakota. They have exclusive and original jurisdiction over any minor who is alleged to be “unruly, delinquent or deprived.”

The state’s 53 counties are divided into seven regionalized districts. These districts also are searchable by county. In each district, a presiding judge supervises court services for all courtrooms in the district. All are also served by a court administrator or administrative assistant who manages the budget, facilities, records, personnel and contracts.

District judges are elected on a nonpartisan ballot to serve six-year terms. The system also maintains a list of about 20 magistrates and eight “judicial referees.”

The state maintains a District Court search feature that enables Internet users to see information about specific cases or to check the local District Court calendar.

North Dakota Municipal Court

The municipal court venues in North Dakota are established by local governments and have jurisdiction over all violations of municipal ordinances, with a few exceptions.

All Municipal Court judges are part-time and are elected by local voters to serve terms of four years.

North Dakota Small Claims Court

North Dakotans with a more minor civil dispute can choose to represent themselves in Small Claims Court. The damages sought in these courts cannot exceed $5,000.
